The tribunal found the factor breached the Code of Conduct. The tribunal proposed a PFEO that the factor complied with before the final order was made, resulting in no formal PFEO being issued.
"By December 2022 the Factor will pay to the Homeowner from their own funds, £50 as compensation for breach of section 3.3 of the 2012 Code and section 3.4 of the 2021 Code."

The homeowner's application was dismissed because they did not properly notify the property factor of the reasons for their complaint, as required by law.
"The Tribunal dismissed the Homeowner’s application upon the basis that the Homeowner failed to notify the Property Factor in writing as to why the homeowner considers that the property factor has failed to comply with the Property Factors (Scotland) Act 2011 Code of Conduct for Property Factors as required by Section 17(3) of the Property Factors (Scotland) Act 2011."
