South Lanarkshire Council, acting as property factor, was found to have breached multiple sections of the Property Factor Code of Conduct 2021 in respect of a property affected by persistent penetrating damp reported since December 2020. Breaches included failure to provide the Written Statement of Services, failure to respond to complaints within required timescales, lack of transparency in accounting for charges, and failure to arrange or progress repairs following a specialist dampness report obtained in April 2024. The Tribunal made a Proposed Property Factor Enforcement Order requiring the factor to initiate a tendering process, consult with the homeowner on timescales and grant applications, and pay £1,000 compensation.
"The Property Factor has been on notice that the Homeowner's Property has suffered damage for nearly 5 years and has not undertaken or progressed repairs within an appropriate timescale."
